Drivers’ Negligence Insurance for Recruitment Agencies 

There are many risks facing driving agencies and if you are a recruitment agency placing temporary drivers, then you are most likely to be required to have drivers’ negligence insurance in place.

Thistle’s drivers’ negligence insurance provides cover for damage caused to a vehicle* where it is the fault of the temporary driver provided by your agency. The intention of this cover is to ensure your clients will be able to reclaim small repair costs, rather than having to claim under their own motor insurance.

Drivers’ negligence insurance is an optional extra when you take out our Public Liability cover.

*This covers damage to the vehicle being driven by the temporary worker, not third party vehicles. 

Driving Agencies

Our policy wording is written in a way that allows flexibility and covers many areas. One of our features does not restrict the size of the vehicles being driven, as well as providing cover for vehicles being driven abroad.

  • Any one claim of either £5,000 or £10,000
  • Any one period of insurance of either £30,000 or £50,000

Drivers Negligence

If you are supplying temporary drivers, they may be required to carry drivers’ negligence insurance. This insurance provides cover against claims in respect of damage caused to vehicles being driven by agency supplied drivers to their clients. This covers damage to the vehicle being driven by the temporary worker, not third party vehicles. 

Agencies may find that clients try to make them liable under contract in respect of such damage caused by the negligent acts of temporary workers. This type of insurance can only normally be purchased in conjunction with public and employers liability.

• Any one claim of either £5,000 or £10,000
• Any one period of insurance of either £30,000 or £50,000
• Excess dependent on experience of driver

Public Liability

Having public liability insurance in place keeps you covered if a customer or member of the public suffers a loss or injury because of your business. Typical claims considered under this section of insurance includes injury or death to a person who isn’t an employee of your business, as well as damage to property belonging to another person. You can buy this cover as part of your flexible business insurance policy, or as a stand-alone policy – whatever suits you.

• Cover up to £10m worth of public liability cover
• Inclusion of ‘indemnity to principal clause’ as standard for signing third party agreements or contracts
• Contractual Liability clause included as standard
• No need to refer every contract ‘for insurer approval’

Employers Liability

Employers’ Liability is a compulsory cover that provides protection against legal liability for bodily injury to your agencies employees, including the cost of expenses. In the event of an employee being injured or killed in work you will require the assistance of an insurer and most likely a solicitor to help decide whether you’ve a responsibility or obligation to pay damages to the claimants, which include their estate or dependents. Thistle’s policy can help with this.

• Limits of indemnity available at £10m or £25m
• Help to defend and pay damages for accidents to temporary and permanent workforce
• Contractual Liability clause included as standard
• No need to refer every contract ‘for insurer approval’

Professional Indemnity
Professional Indemnity Insurance – known as PI insurance or, in some cases, indemnity insurance – is there to protect you if your client suffers a financial loss through your work for them. If a mistake is made by your recruitment agency, it is better to have an insurer pay for the loss than your business suffer the financial sum on your balance sheet, or the loss being pursued against the responsible employee of the agency.

  • Can include Vicarious Liability for Personnel Supplied
  • Issued on a Civil Liability basis – offering more comprehensive protection than a negligence only wording
  • Loss of Documents and Compensation for Directors / Partners and employees attending court as standard additional benefits of cover
  • Internet and Multimedia Liability included
Legal Expenses
By having legal expenses cover, your recruitment agency will be provided with protection for a measure of legal costs and expenses arising from specified civil and criminal incidents in connection with your business.

Other features of this policy include:

• £250,000 limit per claim
• Cover from the insurer for regulation 5 of the Agency Worker Regulations 2010
• Helpline telephone services including counselling for employees and their family members

Directors and Officers Liability
Directors’ and Officers’ liability insurance – also known as D&O insurance – covers the cost of compensation claims made against your business’s directors and key managers (officers) for alleged wrongful acts. These include (but are not limited to) acts such as breach of trust, breach of duty, neglect, error, misleading statements or wrongful trading.

• £nil policy excess
• Flexible limits of indemnity from £100,000 to £5,000,000

Business Interruption
Business interruption insurance provides protection against the consequential loss of income a business may experience following an insured and unexpected event – such as a flood or fire which would result in a period where you would have to stop trading. Both the indirect loss of business and your revenue can be protected by the cover. We have 2 types of cover available – Loss of Income and Additional Expenditure.
Office Package

Your office is one of your most important assets, so it’s vital that you’re properly protected. Our Office Package cover provides indemnity for accidental loss or damage to property (including glass) owned or in your custody. Thistle’s cover responds to a number of risks including fire, flood and theft, enabling you to get your business back up and running as quickly as possible.

Other features of this policy include:

• Automatically notes the interest of third parties such as mortgage companies or purchase / lease companies
• Up to £1,000 for replacement of locks where keys to the premises are lost or stolen
• A 15% uplift to the Declared Values which is beneficial in the event of inflation where the selected sum insured is below the true cost of replacement
• Maximum of £2,500 for contents taken to exhibition and road shows

Specified Business Equipment - All Risks

Tablets, smartphones and laptops by their very nature are small and portable as well as expensive. A normal office policy would require the accident or theft of these items to arise within the business premises, which is contrary to the items intended use. Business All Risks mean insurer assistance on a much wider Geographical basis from the UK only, up to Worldwide.

Other features of this policy include:

• An ‘all risks’ basis if the item is not damaged by an excluded item, such as faulty or defective workmanship that the item is insured
• Cover is now without deduction for wear and tear
• Select UK only, Europe or Worldwide cover

Loss of income
This protects the amount of income that you could potentially lose during the period of time you would need to stop trading to enable you to continue to pay ongoing overhead costs like employee salaries.
Personal Accident for Temporary Workers

Thistle’s Personal Accident insurance covers your recruitment agency’s temporary workers in the event of death and / or permanent disablement whilst they are on assignment or travelling to and from their usual place of residence (or the agency premises) to their assigned place of work.

This product differs from Employer’s Liability insurance as the payments are not assessed or decided by proving fault or trying to quantify an amount of money that would compensate the harm suffered. The payment is made due to the accident taking place.

Other features of this policy include:

• Cover for temporary workers to and from their place of assignment
• Provides a benefit to your temporary workforce should they have a serious injury, which wouldn’t be insured under a typical Employer’s Liability policy

Additional Expenditure Cover
Cover in order to prevent or minimise the interruption of or interference with the Business during the Indemnity Period (including the cost of removal to and from temporary premises and expenses incidental thereto, increase in rents, rates and taxes, salaries of additional staff and overtime payments) but only in so far as such additional expenditure is not recoverable under any other item of the Policy.
Fidelity Bonding
This covers theft of goods (not cash / jewellery) by temporary workers who are required to be covered for theft of goods in the vehicle whilst they are driving.
